Gilbert Auto misses response deadline

Chapter 11 filing has stayed all court proceedings

Gilbert Auto Ford will be keeping its Moscow dealership for the time being despite failing to respond to a lawsuit by the property owner seeking either back rent or eviction due to protections afforded by the company's filing for Chapter 11 bankruptcy last month.

Chetwood Properties LP of Boise filed the complaint in Latah County Second District Court in mid-March asking Judge John Stegner to issue a writ of restitution that would evict Gilbert Auto from the 2.85 acre property on South Blaine Street at the Troy Highway should the company fail to respond with a commitment to paying its debt and remain on the property. Gilbert Auto had until Wednesday to respond under the complaint.
